RoofLog Mobile Application End User License Agreement

This End User License Agreement ("License") is between you, the individual installing or using the RoofLog mobile application (the "Application"), and Gieson Co, a Florida corporation ("Gieson Co.", "we", "us").
By downloading, installing, or using the Application, you agree to this License. If you do not agree, do not install or use the Application, and delete it from your device.
1. Relationship to the RoofLog service
The Application is a client for the RoofLog hosted service. It is not useful on its own — it requires an account on the RoofLog service and an internet connection.
This License covers the Application software only. Your use of the RoofLog service itself, and all rights in the data you record through it, are governed by the RoofLog Subscription Terms of Service at https://therooflog.com/terms, or by the signed subscription agreement between Gieson Co. and the organization whose workspace you access. In any conflict about the service, its data, or its fees, those terms control; this License controls only as to the Application software on your device.
You are typically not the party paying for RoofLog. The organization that granted you access to a workspace controls that access and may revoke it at any time.
2. License grant
Gieson Co. grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Application on devices you own or control, solely to access the RoofLog service through an account you are authorized to use, and solely for your business purposes.
On Apple platforms, this license is granted under the Usage Rules in the Apple Media Services Terms of Use, including any permitted Family Sharing or volume purchase provisions.
This is a license, not a sale. Gieson Co. and its licensors retain all right, title, and interest in the Application, including all intellectual property rights.
3. Restrictions
You may not: copy the Application except as necessary for ordinary use; modify, adapt, translate, or create derivative works of it; reverse engineer, decompile, or disassemble it, except to the extent that restriction is unenforceable under applicable law; rent, lease, lend, sell, redistribute, sublicense, or make it available over a network for use by multiple devices at once; remove or alter any proprietary notice; circumvent any security, access control, or usage limit; or use the Application to develop a competing product.
You may not use the Application to access any workspace you have not been authorized to access, or to extract data from a workspace for any purpose other than performing work for the organization that granted you access.
4. Your account and conduct
You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Do not share credentials with anyone.
Notify your workspace administrator and support@therooflog.com promptly of any suspected unauthorized use.
5. Device permissions and what the Application accesses
The Application requests the following, each only when needed for a feature you use:

Location data is attached to photographs you take and is uploaded with them. It is not used to track you, is not collected in the background, and is not shared with advertisers. The Application contains no advertising, no analytics SDK, and no third-party tracking.

6. Safety — read this one
The Application is a record-keeping tool, not a safety device.
Rooftops are hazardous work environments. Do not use the Application while walking on a roof, near an unguarded edge, near a skylight, or in any position where looking at a phone puts you at risk. Stop, position yourself safely, then use the app.
Nothing in the Application — including condition colors, pin positions, maps, training content, or AI-generated output — is engineering, roofing, HVAC, inspection, or safety advice, or any certification of the condition or safety of any roof, equipment, or structure. It does not authorize any person to access a roof or work on equipment. Follow your employer's safety procedures, applicable regulations, and the property owner's site rules. You are responsible for your own safety and for verifying any information before relying on it.
Maps and location are approximate. Satellite imagery may be outdated or misaligned, and GPS on a phone is accurate to only a few meters. Pin positions indicate approximate locations, not surveyed ones.
7. AI-assisted features
The Application includes AI-assisted features described in full in the RoofLog Terms of Service: voice-note transcription, equipment nameplate reading, and an in-app support assistant.
Their output is generated automatically and may be inaccurate, incomplete, or wrong. Nameplate readings are proposals that go to your workspace's approval queue and never change a record by themselves. Verify before relying on anything the AI produces.
Audio you record and photographs you submit for nameplate reading are sent to our AI providers for processing. Our agreements with those providers do not permit them to use that content to train their models. Providers are listed in the Terms of Service and Privacy Policy.
8. Updates, changes, and termination
We may release updates, and your device or app store may install them automatically. Updates are covered by this License. We may add, change, or remove features.
This License continues until terminated. It terminates automatically if you breach it, and you may terminate it at any time by deleting the Application. Access to the RoofLog service may also end independently of this License — for example, if your workspace administrator revokes your access or your organization's subscription ends.
On termination, stop using the Application and delete all copies. Terminating this License does not delete anything you recorded in a workspace — those records belong to the organization that owns the workspace.
Sections 3, 6, 7, 9 through 16 survive termination.
Terms required for Apple platforms
Sections 9 through 15 apply to the Application obtained through Apple's App Store or TestFlight, and satisfy the minimum terms required by the Apple Developer Program License Agreement. Where they conflict with anything above, these sections control as to the Apple-distributed Application.
9. This License is with Gieson Co., not Apple
You acknowledge that this License is concluded between you and Gieson Co. only, and not with Apple Inc. Gieson Co., not Apple, is solely responsible for the Application and its content.
10. Scope of license
The license granted in Section 2 is limited to a non-transferable license to use the Application on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms of Use, except that the Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
11. Maintenance and support
Gieson Co. is solely responsible for providing any maintenance and support services for the Application, as specified in this License or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

12. Warranty
Gieson Co. is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.
In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Gieson Co.'s sole responsibility.
The Application is otherwise provided "AS IS" and "AS AVAILABLE," without warranty of any kind. To the maximum extent permitted by law, Gieson Co. disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and does not warrant that the Application will be uninterrupted, error-free, or secure, or that any information it displays is accurate, complete, or current.
13. Product claims
Gieson Co., not Apple, is responsible for addressing any claims of yours or any third party relating to the Application or your possession and/or use of the Application, including but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the Application's use of the HealthKit and HomeKit frameworks (which the Application does not use).
14. Intellectual property rights, legal compliance, and export
In the event of any third-party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, Gieson Co., not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You further agree to comply with all applicable third-party terms of service when using the Application.
15. Apple as third-party beneficiary; developer contact
Apple and Apple's subsidiaries are third-party beneficiaries of this License, and upon your acceptance of this License, Apple will have the right (and will be deemed to have accepted the right) to enforce this License against you as a third-party beneficiary of it.

16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GIESON CO. IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO THE APPLICATION.
GIESON CO.'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS LICENSE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APPLICATION, OR (B) TWENTY-FIVE UNITED STATES DOLLARS (US$25). Liability relating to the RoofLog service is governed by the Terms of Service or the applicable subscription agreement, not by this License.
WITHOUT LIMITING THE FOREGOING, GIESON CO. IS NOT LIABLE FOR THE COST OF REPAIRING OR REPLACING ANY EQUIPMENT, ROOF, OR BUILDING; FOR ANY PROPERTY DAMAGE OR PERSONAL INJURY; FOR ANY LAPSED, DENIED, OR VOIDED WARRANTY OR INSURANCE CLAIM; OR FOR ANY MISSED MAINTENANCE, INSPECTION, OR COMPLIANCE DEADLINE.
Nothing in this License limits liability for fraud, willful misconduct, gross negligence, or personal injury caused by negligence, where that limitation would be unenforceable.
17. Third-party components
The Application incorporates third-party software and services, including mapping and imagery from Google Maps Platform, subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy, which you agree to as a condition of use. Open-source components are licensed under their respective licenses, which are available on request from support@therooflog.com.
18. Changes to this License
We may update this License. Material changes will be notified in the Application or by email, and continued use after the effective date constitutes acceptance. If you do not accept a change, stop using the Application and delete it.
19. Governing law
This License is governed by the laws of the State of Florida, without regard to conflict-of-laws rules, and the courts located in Palm Beach County, Florida have exclusive jurisdiction — except where a mandatory consumer protection law of your place of residence provides otherwise, and except that nothing here limits Apple's rights under Section 15.
20. General
If a provision is unenforceable, it is limited to the minimum extent necessary and the remainder stays in effect. Failure to enforce is not a waiver. You may not assign this License; we may assign it to a successor in a merger, acquisition, or sale of substantially all assets. This License, together with the Terms of Service and Privacy Policy, is the entire agreement about the Application.
